INSIDER DEALING AND SFC INVESTIGATIONS​

Hong Kong has the second largest securities market in Asia which is regulated by the Securities and Futures Commission. Securities and Futures Ordinance provides a complex regulatory framework which governs the financial market. Under the Ordinance the Commission has powerful tools of investigation not available to other prosecuting authorities, in particular the power to demand answers under interrogation. Members are available to attend at search and seizure or at the offices of the SFC to give early advice.

The legislation contains both civil and criminal provisions for the control of financial misconduct and we at Central Chambers have experience in dealing with all aspects of market control in both the civil and criminal courts. This area of law ties in closely with commercial crime and fraud where members have particular strength. 

Members of chambers have experience in securities and financial regulatory work, including the Market Misconduct and Securities and Futures Appeal Tribunals, as well as corporate restructuring, IPO and bond issues and related tax and company law.
