JUDICIAL REVIEW​​​​​​​ AND ADMINISTRATIVE LAW​

Judicial Review is the procedure by which the courts supervise the exercise of public power on the application of an individual. It is available only when all other remedies have failed. Anyone who is affected by the action of a public or government body such as an enforcement agency, the police, a regulator, tribunal or licensing authority may apply to the High Court for a remedy. If the action is found to be unlawful the court has the power to overturn the decision, award damages and/or make orders to compel the authority to do its duty or prevent it from acting illegally. 

Judicial Review is an important safeguard against the abuse of power in a society operating under the Rule of Law. The power of an impartial, independent and robust judiciary to oversee executive and administrative action and to overturn it if necessary, protects us all. 

The role of the administrative court has become more prominent since the enactment of the Basic Law and it is a rapidly expanding area of practice. Members of our chambers are experienced in mounting such challenges to official decision making where other avenues have failed.
